Plain English. Read these before you use Mortgage Defender.

1. What this service is

Mortgage Defender is an AI-powered software tool that reads mortgage and foreclosure documents — Deeds of Trust, Notes, Assignments, Notices of Default, Notices of Trustee Sale, servicer letters — and flags potential defects. It is a software service.

It is not legal advice. It is not a substitute for an attorney. The output is an educational analysis to help you understand what your documents say and what questions to ask. Any decision about how to act on that information — including filing anything in court — is yours alone.

2. No attorney-client relationship

Mortgage Defender is a software service. We are not a law firm. Using this service — uploading documents, reading reports, downloading letters or court drafts — does not create an attorney-client relationship between you and Mortgage Defender, its employees, or its contractors.

If you want legal advice tailored to your situation, talk to a licensed attorney in your state.

3. No outcome guarantee

We do not guarantee any specific outcome. Whether a defect we flag is recognized by a court depends on the facts of your case, the jurisdiction you’re in, the judge assigned, and judicial discretion. Two cases with similar documents can come out differently.

Past results — ours or anyone else’s — do not predict future results.

4. You must be 18 or older

This service is for adults only. By creating an account or using Mortgage Defender, you affirm that you are at least 18 years old. We do not knowingly accept users under 18.

5. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to this service is limited to the amount you paid us for the service in the 12 months preceding the claim.

We are not liable for indirect, consequential, incidental, special, or punitive damages — including lost profits, lost data, loss of your home, or loss of any legal right — even if we were told such damages were possible.

6. Governing law

These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these terms or this service shall be resolved exclusively in the state or federal courts located in King County, Washington, and you consent to the jurisdiction of those courts.

7. Changes to these terms

We may update these terms from time to time. When we do, we’ll change the “Last updated” date at the top of this page. If you keep using the service after we make changes, that counts as your acceptance of the updated terms. If you don’t agree, stop using the service.
